A California court has ruled that the owner of a bakeshop does not have to bake a wedding cake for a gay couple. You read that right, a California court!
The Daily Caller reports that “Superior Court Judge David Lampe denied the State of California’s request for a preliminary injunction that sought to force bakeshop owner Cathy Miller to design a wedding cake for a gay couple.”

According to the suit, Miller was approached by two lesbians and was asked to design and bake a cake for their matrimonial event. They women claimed that Miller refused to perform the service because of the sexual orientation of the customers. When the lesbians posted the incident on social media, the Golden State took up their cause and filed suit.
In terse language, the judge said forcing a private business to perform an action it does not want to do because it violates their beliefs “would do violence to the essentials of Free Speech guaranteed under the First Amendment.”
The suit against Miller not only aimed to force her to bake the cake, but threatened to close down her business if she refused a court order, tactics similar to those practiced by tyrannical governments.
Chief counsel for Miller, Charles LiMandri, told reporters, “We are pleased that the judge recognized that the First Amendment protects Cathy’s freedom of speech. This is a significant victory for faith and freedom because the judge indicated in his ruling that the State cannot succeed in this case as a matter of law. No doubt the California officials will continue their persecution of Cathy, but it is clear that she has the Constitution on her side.”

The ruling comes as another “cake baking incident” in Colorado dating back to 2012 comes before the Supreme Court. In that case, “a baker in Denver refused to bake a wedding cake for a gay couple. Lower courts had previously ruled that Jack Phillips, the owner of Masterpiece Cakeshop had violated the state’s accommodation laws by refusing to serve a customer based on sexual orientation” writes the Daily Caller.
